These Terms of Service (the "Terms") govern your access to and use of the Boss Up Wealth Circle website, community, software packages, courses, mentorship, digital store, and the Referral Program (together, the "Services"). The Services are provided by The AJ Collective ("Boss Up Wealth Circle," "we," "us," or "our").
By creating an account, purchasing a membership or product, joining the community, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
01Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Services. When you create an account, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
02What we offer
Boss Up Wealth Circle brings community, software, tools, and training together in one place. Depending on what you purchase, the Services may include:
- Circle Membership — a recurring monthly membership giving you access to the community, resources, and ongoing materials.
- Software packages — including tax software and financial-education software (monitoring & education), provided directly or through third-party software vendors.
- Courses, systems & accelerators — educational programs and business-building systems delivered as digital content.
- Mentorship — group and private mentorship and coaching sessions.
- Digital store — done-for-you digital products and storefront setups.
- The Referral Program — an opt-in program to earn commissions by sharing your referral link (see Section 6).
Specific features, pricing, and inclusions are described at the point of purchase and may change over time. The purchase page controls what is included in a given offer.
03Client Education Program — software, monitoring & education
Our Client Education Program provides software, financial monitoring, and financial education. It gives you tools to view and understand your financial information and educational content to help you build a plan.
You are responsible for how you use the software and information. If you need advice about your specific situation, consult a qualified professional.
04Subscriptions & billing
Recurring subscriptions
Some Services are billed as recurring subscriptions — for example, the Circle Membership at $97 per month and financial monitoring at $49.99 per month (prices as listed at purchase and subject to change with notice). By starting a subscription, you authorize us and our payment processor to charge the applicable recurring fee to your payment method on each billing cycle until you cancel.
One-time purchases
Certain products (such as software packages, accelerators, the digital store, and mentorship) are sold as one-time purchases at the price listed at checkout.
Renewals, cancellation & changes
Subscriptions renew automatically at the then-current rate until canceled. You may cancel a subscription at any time through your account or by contacting [email protected]; cancellation stops future charges and takes effect at the end of the current billing period. Access to subscription benefits ends when the paid period ends. We may change prices, fees, or the features included in a plan; where required, we will provide advance notice, and continued use after a change takes effect constitutes acceptance.
Taxes & failed payments
Prices are exclusive of applicable taxes unless stated otherwise; you are responsible for any taxes associated with your purchase. If a payment fails, we may retry the charge and may suspend or terminate access until amounts owed are paid.
05Refunds
06The Referral Program
The Referral Program lets participants ("referral partners") earn commissions by sharing a personal referral link to Boss Up Wealth Circle products and services. Participation is optional and subject to these Terms and any additional program rules we publish.
- How it works. When someone makes a qualifying purchase through your referral link, you may earn a commission at the rates published in the program materials. We may also offer leadership or team-based bonuses as described there.
- Payouts & hold period. Commissions are calculated on qualifying, completed sales and are typically paid on a weekly schedule after a hold period. The hold period covers refunds, chargebacks, and fraud review. Commissions tied to a sale that is later refunded, reversed, or charged back may be deducted or clawed back.
- Not employment. Being a referral partner does not make you an employee, agent, partner, or joint venturer of Boss Up Wealth Circle or The AJ Collective. You are an independent participant, responsible for your own taxes, expenses, and compliance. You have no authority to bind us or make promises on our behalf.
- No income guarantee. Earnings depend on your own effort, skill, network, and market conditions. We do not guarantee any level of income or earnings. Any figures mentioned anywhere are illustrative, not a promise of your results, and many participants earn little or nothing.
- Honest promotion (FTC). You must market truthfully and lawfully. Do not make false, misleading, or unsubstantiated claims — including income or results claims — and always clearly disclose your referral relationship when you promote (as required by the FTC and applicable law). Spam, deceptive advertising, cookie-stuffing, trademark or paid-search abuse, and self-referrals are prohibited.
- Changes & termination. We may change commission rates, bonuses, hold periods, or program rules, and may suspend or terminate any participant for violating these Terms or the program rules. Unpaid commissions associated with prohibited conduct may be forfeited.
Throughout the Services we refer to this exclusively as the Referral Program and to participants as referral partners.
07Acceptable use
You agree not to, and not to help anyone else:
- Use the Services for any unlawful, fraudulent, or deceptive purpose;
- Share, resell, or redistribute paid content, software licenses, or community access without authorization;
- Harass, threaten, defame, or abuse other members, staff, or third parties;
- Upload malware, attempt to breach security, scrape, or interfere with the Services or servers;
- Infringe intellectual-property or privacy rights, or post content you have no right to share;
- Misrepresent your identity, affiliation, or your results and earnings.
We may remove content and suspend or terminate accounts that violate these rules, at our discretion.
08Intellectual property
The Services and all related content — including courses, software, text, graphics, logos, the "Boss Up Wealth Circle" name and marks, videos, and templates — are owned by The AJ Collective or its licensors and are protected by intellectual-property laws. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content you purchase for your own use. You may not copy, distribute, publicly share, sell, or create derivative works from our content except as expressly permitted. Any content you submit remains yours, but you grant us a non-exclusive license to host, display, and use it as needed to operate and promote the Services.
09Third-party services
The Services rely on third-party providers — including payment processors, email and communication tools, the community platform, and software vendors (such as the financial-education software provider). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, and their availability or terms may change.
10Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any content is accurate or complete.
Nothing in the Services is legal, financial, tax, accounting, or investment advice, and no professional relationship is created by your use of the Services. We make no guarantee of any financial result, business result, or income. Testimonials and examples are not typical and are not a promise of your results.
11Limitation of liability
To the maximum extent permitted by law, The AJ Collective and its owners, employees, and related entities will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Services — even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the Service giving rise to the claim in the 6 months before the claim, or (b) $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12Indemnification
You agree to defend, indemnify, and hold harmless The AJ Collective and its owners, employees, and related entities from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, your participation in the Referral Program, or your violation of these Terms or of any law or third-party right.
13Termination
You may stop using the Services at any time and cancel any subscription as described in Section 4. We may suspend or terminate your access — with or without notice — if you violate these Terms, create risk or legal exposure for us, or fail to pay. Upon termination, your right to access the Services ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
14Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there. Before filing any claim, you agree to first contact us at [email protected] so we can try to resolve it informally.
15Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Changes take effect when posted, and your continued use of the Services after that means you accept the updated Terms.
